Еврокомиссия ударит по монополизму "Газпрома" штрафами
"Коммерсант" сообщает о первой реакции клиентов концерна в Европе на начало антимонопольного расследования. В частности, премьер Литвы Андрюс Кубилюс отметил: "Это очень важное событие, которое может довольно сильно изменить ситуацию на газовых рынках Европы и поведение самого "Газпрома", прежде всего в нашем регионе, во всей Центральной Европе".
Именно Литва в 2011 году обратилась в совет по вопросам конкурентоспособности Еврокомиссии с требованием провести расследование возможных нарушений холдинга. Страна является одним из наиболее проблемных клиентов "Газпрома", с которым у него продолжаются споры о цене газа, напоминает сайт Заголовки.ру.
Главная претензия к ценообразованию - разница в ценах между покупателями Западной и Восточной Европы. Польша и Литва жалуются на то, что платят за российский газ на 50-100 долларов за тысячу кубометров больше, чем Германия или Италия. Если претензии к "Газпрому" окажутся обоснованными, от компании потребуют заплатить, по разным оценкам, 10-30% от годовой выручки. По самым скромным оценкам, сумма может достигнуть 5,7 млрд долларов, что в 11 раз больше самого большого штрафа, когда-либо наложенного Еврокомиссией на юридическое лицо.
В "Газпроме" уверяют, что следят за соблюдением всех законодательных норм на рынках сбыта и его работа (в том числе применяемые принципы ценообразования) соответствует стандартам, которые используют и другие производители и экспортеры газа.
При этом в монополии напомнили Брюсселю, что "Газпром", как российская госкомпания, не подчиняется юрисдикции ЕС и наделена "в соответствии с российским законодательством публично значимыми функциями и статусом стратегической организации, контролируемой государством".
"Газпром" поставляет в Европу примерно четверть от всего объема потребляемого европейскими странами природного газа, причем его цены существенно превосходят спотовые на мировом рынке.
Это оборачивается регулярно вспыхивающими российско-европейскими "газовыми войнами", обостряющимися к началу отопительного сезона. Так, прошлой осенью были проведены обыски в европейских "дочках" "Газпрома", включая центральный офис в Берлине, напоминают "Новые Известия". Россия не смогла зимой поставить дополнительные объемы "голубого топлива" итальянцам, когда там ударили небывалые морозы.
Тем не менее в итоге российская корпорация вынуждена была пойти на уступки. В феврале контрактные цены, действующие в рамках долгосрочных контрактов на газ для потребителей из Европы, были снижены примерно на 10%.
ЕК прежде всего интересуют долгосрочные контракты между "Газпромом" и другими предприятиями, которым поставлялся российский газ. Как пояснил представитель ЕК Антуан Коломбани "Независимой газете", расследование по "Газпрому" затрагивает восемь европейских государств - Польшу, Чехию, Словакию, Венгрию, Болгарию, Эстонию, Литву, Латвию. Разбирательство касается поставок газа в Центральную и Восточную Европу, в страны, где "Газпром" является доминирующим игроком".
Покупатели российского газа в Восточной и Центральной Европе будут использовать расследование, чтобы сбить цену при переговорах с поставщиком, не исключает руководитель направления "Мировая энергетика" сколковского Энергетического центра Татьяна Митрова в "Российской газете". Последствия расследования могут быть неоднозначными как для отечественной компании, так и для европейских потребителей: альтернативы поставкам газа из России в ряде стран Центральной и Восточной Европы пока нет.
